This is an appeal by the landlord from a decision of the Director of Residential Tenancies dated May 26, 2022. In that decision the Residential Tenancies Officer dismissed the landlord’s application to terminate the tenancy on the ground that the tenant was in breach of the Residential Tenancies Act and the lease by failing to provide proof of tenant insurance.

This is an appeal of an Order of the Director dated April 14, 2022, ordering vacant possession of the rental unit at 16 Bently Drive, Apartment 110, Halifax, Nova Scotia, effective May 3, 2022. As well, the Tenant was ordered to pay the sum of $4526.84 to the Landlord.

Alfendi vs Capreit Ltd Partnership, 2024 NSSM 7

This is an appeal of the Decision of Residential Tenancy Officer Vanessa Betts dated December 14, 2023.

Her decision was based upon a teleconference held December 12, 2023 to hear an application for termination of tenancy and vacant possession made by the Landlord, to end Ms. Alfandi’s month to month lease, which had commenced July 1, 2020.

Tenancies dated December 8, 2023.

This case raises the question of to what extent, if any, is a Residential
Tenancies Officer (and by extension this court) bound to terminate a tenancy when
the tenant is, or has been, in arrears of rent.
